Soca in Japan, LLC – Terms of Use

Notice: PLEASE READ THESE TERMS CAREFULLY BEFORE USING OUR SERVICE.
We are Soca in Japan (“Soca in Japan”, “SIJ”). We provide the website at www.socainjapan.com (the “Site”) and underlying services (collectively, the “Service”). Each person who uses the Service is referred to as “you” or “your” or “patron”.
NOTHING IN THESE TERMS IS INTENDED TO AFFECT YOUR RIGHTS UNDER THE LAW IN YOUR PLACE OF RESIDENCE. IF THERE IS A CONFLICT BETWEEN THOSE RIGHTS AND THESE TERMS, YOUR RIGHTS UNDER APPLICABLE LOCAL LAW WILL PREVAIL.
SOCA IN JAPAN’S AGREEMENT (TERMS & CONDITIONS)
The payment of your deposit or any other payment or by attending Soca in Japan events confirms that you accept and agree to Soca in Japan’s Agreement (Terms & Conditions) (the “Agreement”). If you utilize our services on behalf of another person, company or organization (“Organization”), then you promise and warrant that you are authorized by the Organization and that you have the right to bind the Organization to these Terms. This Agreement is subject to change by SIJ at any time after written notice of the change.
ALL DEPOSITS AND PAYMENTS ARE NON-REFUNDABLE
Due to the nature of our events all payments, deposits, installments are non-refundable.
CARNIVAL COSTUMES
Conservative style body wear or Carnival costumes are provided by socainjapan.masos.app. These costumes are made to order and thus all purchases are non-refundable. All Soca in Japan tour packages includes a conservative style body wear (body covered) that can be used for Japan Caribbean Carnival. Optionally, patrons can upgrade to a Pretty mas costume for as low as $95 for male, or $115 for female. Costume selection and measurements will be available on socainjapan.masos.app beginning April 2024.
CANCELLATION OF ADVERTISED EVENTS BY SIJ
In the event of civil unrest, war, acts of god, international disputes, sightseeing vendors nonoperational or bankruptcies, or for any other reason whatsoever beyond the control of SIJ, SIJ in its sole discretion may cancel, advance, or postpone, substitute any scheduled event and SIJ shall not be liable for any loss whatsoever to patrons by reason of such cancellation, advancement, postponement, or substitution. Thereupon, SIJ shall return to you, if the advertised event is completely canceled, your payments, or, if the advertised event is partially canceled, a proportion of your payment. Under such circumstances, SIJ shall have no further liability for damages or compensation of any kind. Please note that the availability of any refund additional fees such as, but not limited to, third party credit card company processing fees will be determined in accordance with the applicable cancellation policies for such other products or services. Also note patrons on installment plans with payments in arrears of 30 days or more may not be eligible for refunds due to our many contract obligations with our suppliers.
CANCELLATION BY SIJ ARTIST
SIJ has entered into an agreement with each performing artist to perform in accordance with terms specified therein. However, SIJ shall not be held liable or responsible for the failure of any artist or musician to perform beyond SIJ’s control. This includes but not limited to civil unrest, war, international disputes, acts of god, illness, death and government restraints. In the event of any failure of contracted artists to perform during advertised events, SIJ, in its sole discretion, may engage a replacement artist or may change, postpone or terminate all or any part of the event or the entertainment program or change the program or itinerary. In such case, SIJ shall have no liability to any patron for any loss, damage, cost or expense whatsoever by reason of such change.
SAFETY DURING SIJ EVENTS
You assume sole responsibility for your own safety during SIJ events. SIJ makes it a priority to keep our patrons safe, however final responsibility is solely on the patron. Please follow all safety instructions by SIJ team.
PHOTOGRAPHY/VIDEO RELEASE
Video or audio recording, filming, or photographs may occur during SIJ events, which may be owned, licensed, assigned or distributed nationwide and worldwide by SIJ, their affiliates and assignees. You hereby allow, waive and authorize SIJ, its affiliates, and assignees the right to use your likeness in any manner whatsoever. You will not receive any compensation for such use and waive any right to bring any action in law or equity against SIJ, their affiliates and assignees for such use.
ZERO TOLERANCE POLICY
SIJ have a zero-tolerance policy regarding threats, violence, discrimination, sexual harassment, property or venue destruction while enjoying SIJ events. When utilizing the charter buses it's strictly forbidden to bring food or drinks on the bus. When the charter bus in motion please be seated. It is forbidden to stand, dance, or engage in unsafe acts that maybe disruptive to the driver, staff, or other patrons on the bus when the bus is in motion. Violations of this policy may lead to cancellation of your registration or immediate removal from event, arrest and/or criminal prosecution as appropriate. In such cases, SIJ shall not be liable for any refund or other compensation or damages.
VENDING OR ADVERTISING
Unless approved by SIJ, NO VENDING OR ADVERTISING OF ANY KIND IS ALLOWED during SIJ events. For information on sponsoring or vending, please email info@socainjapan.com. It is strictly forbidden to sell any unauthorized merchandise or advertise any brands or products during SIJ events. Anyone found in violation of this policy will have his or her unauthorized merchandise confiscated, and they will be removed from the event. This policy will be strictly enforced.
MEDICAL CARE
All patrons must ensure that they are medically and physically fit for SIJ events. Expect a lot of working and standing for all event. You assume and all risks associated with travel and attending SIJ events. If you are traveling to Japan from overseas medical care may not be available in your native language. In case of allergies, we recommend consulting with a healthcare provider in your country before visiting Japan. We highly recommend the purchase of Travel Insurance to cover any unforeseen and unexpected medical expenses.
2024 MONTHLY PAYMENT PLANS TO SIJ
For patrons of our sightseeing tour package who are unable to pay in full at the time of purchase, we offer a payment plan that will divide your payment into monthly installments based on the date of which you registered. There will be a $10 per installment fee. You will receive a payment schedule which details the monthly payment plan. Installments are due on the 15th of each month, with your final payment due no later than June 30th, 2024.
REGISTRATION FOR THE TOUR
A $350 non-refundable deposit is required to register. The registration fee goes towards your package balance.
LATE PAYMENTS
Monthly payments in arrears of 15 to 28 days will result in $50 late payment fee. Monthly payments in arrears of 30 days or more, unless otherwise arranged with Soca in Japan, will result in forfeiture of deposits. All payments are nonrefundable. If your reservation remains unpaid anytime 30 days past its due date, SIJ reserves the right to cancel your reservation without refund.
PAYMENT TO HOTEL AND ACCOMMODATION
After check-in at the hotel, patrons may be asked by the hotel to put a credit card on file incase of incidentals and or ordered room services.
ROOMMATES
Your decision to accept a roommate for your accommodation while in Japan is at your own risk. SIJ is not responsible or liable in respect of any and all claims or causes of action arising out of or in connection with a roommate.
